1. Agreement to These Terms
These Terms of Service govern your access to and use of TOG_OS, including the website, the platform, and any modules, integrations or services made available through it. By creating an account or using the platform, you agree to be bound by these terms. If you are using TOG_OS on behalf of an organization, you represent that you have authority to bind that organization.
2. Accounts & Access
You are responsible for the accuracy of the information you provide, for maintaining the confidentiality of your credentials, and for all activity that occurs under your account. Access to features and data is governed by the roles and permissions assigned within your organization. You must notify us promptly of any unauthorized use or security concern.
3. Acceptable Use
You agree not to misuse the platform, including by attempting to gain unauthorized access, interfering with the operation of the service, uploading malicious code, infringing the rights of others, or using TOG_OS to violate applicable law. We may suspend or restrict access where we reasonably believe these terms or the security of the service have been breached.
4. Subscriptions, Modules & Billing
TOG_OS is offered through subscriptions and module-based entitlements. Fees, billing periods and included usage are described at the point of purchase or in your order. Unless stated otherwise, fees are charged in advance and renew for the agreed period. Refunds are handled in accordance with our Refund Policy.
5. Your Data
You retain ownership of the data you and your organization submit to TOG_OS. You grant us the rights necessary to host, process and transmit that data to provide and secure the service. We process personal data as described in our Privacy Policy. You are responsible for ensuring you have the right to submit the data you provide.
6. Intellectual Property
The platform, including its software, design, documentation and trademarks, is owned by TOG_OS or its licensors and is protected by applicable law. These terms do not grant you any right to our intellectual property except the limited right to use the service in accordance with your subscription.
7. Third-Party Services
The platform may connect to third-party services through integrations. Your use of those services is subject to their own terms and policies, and we are not responsible for their availability, content or practices.
8. Availability & Support
We work to keep the platform available and secure, and may perform scheduled maintenance or release updates. We do not guarantee uninterrupted or error-free operation. Support is provided through the channels made available in your workspace, and any service commitments are as agreed in your order.
9. Disclaimers & Limitation of Liability
To the maximum extent permitted by law, the platform is provided on an "as is" and "as available" basis without warranties of any kind. We are not liable for indirect, incidental or consequential losses, and our aggregate liability is limited to the fees paid for the service in the period giving rise to the claim.
10. Termination
You may stop using the service at any time. We may suspend or terminate access for breach of these terms, for security reasons, or where required by law. On termination, your right to use the platform ends, and data is handled in accordance with our retention practices and applicable law.
11. Changes to These Terms
We may update these terms from time to time to reflect changes to the service or applicable law. Where changes are material, we will provide notice through the platform or by other reasonable means. Continued use of TOG_OS after changes take effect constitutes acceptance of the updated terms.
